That the contents of Circular No 94/4 be noted and incorporated into Council's policy in regard to land management and land dealings in the future.

 

4.1 History

Extract from General Manager's Report - 17.03.94

 

Council at its meeting on 21 October 1993 resolved to note the contents of Circular No 93/42 with the contents being incorporated into Council's policy in regard to land management and land dealings in the future.

 

In that Circular the emphasis was on the implications in that Council should ensure in regard to certain dealings in land that where the owner is a Government agency, that agency has dealt with any Native Title implications before proceeding.

 

This latest Circular No 94/4 states that every Council will need to be thoroughly familiar with the Commonwealth Native Titles Act, 1993 because Councils are within the definition of "statutory authority" under Section 253 of the Act.

 

This latest Circular states that it replaces previous advice contained in Circular 93/42.

 

This latest Circular is quite extensive and has not been copied in full for that reason, however, copies are available from the undersigned upon request by interested Councillors. Meanwhile, the contents of this latest Circular should also be noted and incorporated into Council's policy in regard to land management and land dealings in the future.

 

RECOMMENDATION:  That the contents of Circular No 94/4 be also noted and incorporated into Council's policy in regard to land management and land dealings in the future.
