Summary:

 

The Council is being offered an additional $487,630 in funding for the construction of Bowra Dam.

 

 

Recommendation:

 

1††††††† That Council accept the offer of $487,630 being for additional financial assistance under the Country Towns Water Supply and Sewerage Program towards unforeseen work in the construction of Bowra Dam.

 

2††††††† That Council thank the Minister the Hon. Kevin Humphries for his offer of additional funding.

 

3††††††† That Council thank Mr Glenn George, Regional Manager North, NSW Office of Water, for following up Councilís requests for additional funding with the Ministerís Office and for facilitating the funding offer.

 

 

OPTIONS:

 

There are no real options.† The Council is being offered an additional $487,630 in funding.† Normally with Country Towns Water Supply and Sewerage Program projects, all financial risk in relation to variations rests with the Council as the final funding offer is based on the contract price.† However Council was apprised of a precedent in relation to a schedule of rates calculation on a variation for additional bulk earthworks.† The additional funding offer is based on this principle.

 

 

DISCUSSION:

 

The Mayor has made representations to the Minister for Natural Resources, Lands and Water on three separate occasions for additional funding for the Bowraville Off River Water Storage on the basis of the significant additional costs incurred in the construction of the core trench.

 

The Hon. Kevin Humphries MP, Minister for Natural Resources, Lands and Water and Minister for Western New South Wales has now offered an additional $487,630 in funding to Council.† This is based on 39.8 per cent of the costs of a schedule of rates calculation for additional eligible expenditure of $1,225,202 in bulk earthworks and related costs.

 

This assistance is in addition to the $14,806,405 already approved for the project, bringing the total approved project financial assistance from the Country Towns Water Supply and Sewerage Program to $15,294.035.

 

It is pleasing that the Minister has now approved Councilís request for additional funding with the offer being issued just before the Government went into caretaker mode for the election on 28 March 2015.

There has been consultation with Mr Glenn George, Regional Manager North in the NSW Office of Water.

FINANCIAL IMPLICATIONS:

The additional funding will improve future budgets in the water fund.

 

Source of fund and any variance to working funds

 

The impact on working funds will depend upon the timing of payment.† It is anticipated that the funding will be forwarded prior to the end of the financial year which will mean a positive impact on the Water Fund of $487,630.

Regional Procurement called an open Panel Source tender for the Provision of Traffic Control Services to participating MIDROC councils, in accordance with Clause 166(a) of the Local Government (General) Regulation 2005.†

 

The tender closed at 10.00am on Tuesday 13 January 2015 and eight (8) tender submissions were received from the following which are listed in no apparent order.

1††††††† That Council accept the tender panel for the Provision of Traffic Control Services as submitted for Regional Procurement Tender No T401415MNC for a period of 24 months commencing on 1 April 2015 and terminating on 31 March 2017.†

 

2††††††† That Council accept that a provision be allowed for a 12 month extension to this contract based on satisfactory supplier performance which may take this contract through to 31 March 2018.

DISCUSSION:

 

The submissions were evaluated using the assessment criteria and weightings in the confidential report together with the evaluation summary detailing name, price and comments.

 

All tender submissions are recommended for inclusion on the Panel which will give Council greater flexibility in the event that the highest ranked contractor is unable to supply the service.

 

It should be noted that the highest ranked tenderer is not the existing contractor who is Mid Coast Traffic Services.

There may be some economic loss to the local area.

There are no risks associated with this report.
