Summary:

 

The Nambucca Heads RSL Club sub-leases Shop 1 Riverside Drive, Nambucca Heads to Rintoul.

 

The Nambucca Heads RSL Club holds the Head Lease for the use of the Crown land that surrounds the RSL Club and the sub-lease for Shop 1 Café and Boat Shed in Nambucca Heads.  For many years the RSL Club has had a sub-lease approved by the Department of Lands and providing the Minister’s consent for the use as a Café and Fishing Tackle & Boat Shed.

 

The existing approval for the sub-lease expired with the Nambucca Heads RSL Club with the Head Lease holder now seeking approval from the Trust, being the Nambucca Shire Council, the Department of Lands and ultimately the Minister’s consent.

 

Council, at its meeting on 10 July 2013, resolved:

 

That Council consent to the transfer of the leases between the Wi-Bi Group Pty Ltd (the transferor) and Tracey Lee Rintoul and Robert Stewart Rintoul (the transferees) as well as to any deeds of assignment and attach its seal to documents as required.

 

Tracey Rintoul and Robert Stewart Rintoul have operated the business since taking over the transfer of the sub-lease on 10 July 2013 in a professional manner and have caused no adverse concerns to either the Nambucca Heads RSL as the holder of the Head Lease or Council as Trust Manager.

 

This matter relates to the renewal of the sub-lease to Rintoul, Shop 1 Riverside Drive, Nambucca Heads. The sub-lease expired 18 November 2013 with the new sub-lease seeking a term of 5 years, with the expiry date being 27 November 2018 which will bring the Head Lease and sub-lease into alignment for the renewal periods.

 

 

 

Recommendation:

 

That Council renew the Nambucca Heads RSL Club Sub-lease to Rintoul for a period of 5 years from 28 November 2013 until 27 November 2018.

 

 

 

OPTIONS:

 

·      Council can accept the report

·      Council can resolve to not approve the renewal of the Sub-lease.

 

 

DISCUSSION:

 

Manager Business Development has contacted the Nambucca Heads RSL Club seeking comments and support for the renewal of the Sub-lease.
