- SEPP (Exempt and Complying Development Codes) 2008 - NSW Housing Code
With the commencement of the NSW Housing Code (SEPP) from 27 February 2009, there are areas of Council's DCP for Exempt and Complying Developments that may not apply or development types that for a twelve (12) month transitional period from the 27 February 2009, may be undertaken under either the new Housing Code or Council's DCP. The two documents cannot be mixed or matched when applying for complying developments and the applicant must clearly indicate on their application under which Legislation the application is being lodged. This applies to applications being lodged with Council or with a Private Certifier.
Under the NSW Housing Code maximum building heights are set at 8.5m throughout the Shire. Under Council's DCP 10 the building height may vary according to Council's Local Environmental Plan 1995 and DCP 3.Within 2 days of issuing a Complying Development Certificate (CDC) all neighbours within 40 metres of the allotment will be notified of the approval by either Council or the Accreditated Certifier issuing the approval.Where the nominated development type is set down under the Housing Code (SEPP) and Council's DCP 10 for exempt developments the SEPP prevails.
